Terms of Service — MAKE IT
These Terms of Service ("Terms") govern your use of the MAKE IT mobile game ("the App"), provided by WinArt ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. The App
MAKE IT is a fast-paced arcade puzzle game with two modes — Make Number and Make Word — plus a daily challenge. The App is offered for mobile devices through the Apple App Store and Google Play. It works offline and does not require an account or login.
2. License to Use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, non-commercial entertainment. You may not copy, modify, reverse-engineer, decompile, redistribute, or resell the App or any part of it, except where such restriction is prohibited by law.
3. Eligibility
You must be old enough to enter into a binding agreement in your country, or have the consent of a parent or legal guardian, to use the App. If you are using the App on behalf of a minor, you accept these Terms on their behalf.
4. In-App Purchases
The App is free to download and play. It optionally offers a one-time "Remove Ads" purchase that permanently removes advertising. This is a single, non-consumable purchase — not a subscription — and is not billed on a recurring basis.
All purchases are processed by the Apple App Store or Google Play, not by us. Prices are shown before purchase and may vary by region and over time. Payments, billing, taxes, and refund requests are handled by Apple or Google under their own terms; we do not directly process payments or issue refunds. You can restore a previous "Remove Ads" purchase on a new device using the restore option provided in the App.
5. Advertising
The free version of the App displays advertising provided by third-party ad networks (including Google AdMob), shown at natural breaks such as switching between game modes. By using the free version you agree to the display of such ads. Purchasing the "Remove Ads" upgrade disables this advertising.
6. Game Progress and Data
Your game progress — such as best level, streaks, and daily challenge results — is stored locally on your device. We do not host user accounts. If you delete the App or your device data, this progress may be lost and cannot be recovered by us. 7. Acceptable Use
You agree not to use the App in any unlawful way, not to interfere with or disrupt the App or its servers and networks, and not to attempt to gain unauthorized access to any part of the App, its advertising, or its in-app purchase systems, including through cheating, automation, or tampering.
8. Intellectual Property
The App and all of its content — including its name, design, graphics, code, sounds, and branding — are owned by Winart or its licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
9. Third-Party Services
The App relies on third-party services, including the Apple App Store, Google Play, Google AdMob (advertising), and RevenueCat (purchase management). Your use of these services is also subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
10. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every device, and we do not guarantee continued availability of the App or any of its features.
11. Limitation of Liability
To the maximum extent permitted by law, Winart shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or game progress, arising out of or related to your use of (or inability to use) the App. Where liability cannot be excluded, it is limited to the amount you paid us, if any, for the App in the twelve months before the claim.
12. Changes to the App and These Terms
We may update, change, or discontinue the App or any of its features at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the latest version. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms or use the App in a harmful or unlawful way. You may stop using the App at any time by uninstalling it.
14. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. Any disputes shall be subject to the courts of that jurisdiction, unless mandatory local consumer-protection laws provide otherwise.
